Coğrafi işaretin markayla ilişkisi

Abstract

Tezimiz marka ve coğrafi işaretler arasındaki hukuki ilişkiyi, bu iki sınai mülkiyet hakkının karşılaşabileceği çatışma alanlarını ve uygulamadaki boşlukları ele almaktadır. Tezin ilk kısmında, marka ve coğrafi işaret kavramlarının tanımı, işlevleri ile hukuki özellikleri açıklanmıştır. Ardından, Türkiye'deki mevzuat düzenlemeleri, özellikle 6769 sayılı Sınai Mülkiyet Kanunu çerçevesinde coğrafi işaretlerin korunması ve marka hakkı incelenmiştir. Tezde coğrafi işaretlerin markalarla ilişkisi, bu iki sınai hakkın aynı ürün üzerinde çatışmaya neden olabileceği durumlar ve bu çatışmaların çözüm yolları da değerlendirilmiştir. Ayrıca, Türk hukukunda ve Avrupa Birliği düzenlemeleri çerçevesinde marka ve coğrafi işaretler arasındaki ilişkiler ve bu ilişkilerin uygulama alanlarında yaratabileceği sorunlar tartışılmıştır. Tezin son kısmında, marka tescili ve coğrafi işaretlerin korunmasına dair yargı kararları ve davalar üzerinden somut örnekler sunulmuş, bu davaların hukuki çözüm yolları analiz edilmiştir. Sonuç olarak, marka ve coğrafi işaret çatışmalarının önlenmesi için önerilen düzenlemeler, uygulamadaki boşlukların giderilmesi ve her iki hakkın daha etkin korunması amacıyla yapılması gereken hukuki iyileştirmeler ele alınmıştır. Our thesis deals with the legal relationship between trademarks and geographical indications, Deconfliction areas that these two property rights may encounter and gaps in application. In the first part of the study, the concepts of trademark and geographical indication are defined and the functions and legal characteristics of both industrial property rights are explained. Then, the legislative arrangements in Türkiye, especially the protection of geographical indications and trademark rights within the framework of the Industrial Property Law No. 6769, were examined. The relationship of geographical indications with brands, the situations in which these two rights may cause conflict over the same product and the ways of resolving these conflicts have also been evaluated. In addition, the relations between trademarks and geographical indications in Turkish law and within the framework of European Union Decrees and the problems that these relations may create in the fields of application are discussed in the thesis. In another important part of the study, concrete examples were presented through judicial decisions and lawsuits related to trademark registration and the protection of geographical indications, and legal solutions to these cases were analyzed. Finally, the proposed regulations for the prevention of trademark and geographical indication conflicts, the legal improvements that need to be made in order to eliminate gaps in the application and to protect both rights more effectively were discussed.
