Türk hukukunda bireysel emeklilik sistemi

Abstract

Modern anlamda sosyal güvenlik sistemi, 1945'li yıllardan bu yana Türkiye'de uygulanmaktadır. Sosyal güvenlik sistemi, yeni oluşturulmasına rağmen yeterince iyi temele dayanmadığından aktif çalışanların sistemi finanse etme finanse oranı yetersiz kalmakta ve hazine yardımı olmadan sistem kilitlenmektedir. Sürdürülebilir bir sistem oluşturabilmek için 1999 yılında İşsizlik Sigortası Kanunu ile reform çalışmaları başlamıştır. Daha sonrasında bireysel emeklilik alanında düzenlemeler yapılmış, 5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası Kanunu ile dağınık yapıdaki sosyal güvenlik sistemi tek çatı altında birleştirilmiştir. 28.03.2001 tarihinde 4632 sayılı "Bireysel Emeklilik Tasarruf ve Yatırım Sistemi Kanunu" ile toplumun ihtiyacı doğrultusunda tamamlayıcı nitelikte ve gönüllük esasına dayalı yeni bir sistem kurulmuştur. Özel sigorta sisteminin bir parçası olmasına rağmen pek çok ülkede olduğu gibi ülkemizde de bireysel emeklilik, kamunun denetim ve gözetimi altındadır. Bireysel emeklilik sisteminden beklenen faydanın sağlanması amacıyla uygulamada olan aksaklıkların giderilmesi için yeni düzenlemeler yapılmıştır. Bu kapsamda otomatik katılım sisteminin uygulamaya konması ile sisteme dahil olan katılımcı sayısında artış sağlanmaya çalışılmıştır. Bu çalışmada dünyadaki sosyal güvenlik reformu ile Türkiye'deki bireysel emeklilik sisteminin gelişimi, uygulanması, sistemdeki eksiklikler nedeniyle ortaya çıkan aksaklıklar, yasal düzenlemeler ve öğretideki görüşler çerçevesinde ele alınacaktır.

Social security system is implemented in Turkey since 1945 in the modern sense. Despite social security scheme occured as newely due to not based on solid foundational it is insufficient for financial acivated personel sandunless support of treasury system is locked. Reformist works has begun for behalf of ocur sustainable system with unemployement insurance law in 1999. Later on, various revisions were made in the system carried out by the studies in the field of individual pension, gathering of social security system sunder the one roof, and maked law number 5510 as the social insurance and general health insurance. A new system has set up in direction that needs of society as the complementary on voluntary basis with Law of individual pension act and investment system numbered 4632 in 28.03.2001. Individual pension observes and audits by public in our country as in many counties despite as part of system of private insurance. In order to provide the expected benefit from the private pension system, the problems that in practice are tried to be resolved by with new regulations. An attempt was provided to increase the number of participants included in the system with the implementation of the automatic enrollment system. This master thesis is under debate in frame of legal arrangement and doctrine opinions for develope of individual pension system in Turkey with social securty reform in world, apply and problems caused by deficiencies in the system.
