Devletin temel amaç ve görevlerine dair bir inceleme: Yeni bir madde teklifi

Abstract

İlk bölümünde devletin amacı nedir sorusuna dair tarihsel bir değerlendirme yapılmıştır. Bu tarihsel değerlendirme; "Antik Yunan ve Roma İmparatorluğu Anlayışında Devletin Amacı", "Ortaçağ Avrupası'nda Devletin Amacı ve Modern Devletin Doğuşu", "Türk- İslam Medeniyeti'nde Devletin Amacı ve Devlet Tefekkürü" isimli üç alt başlık ile yirmi bir farklı düşünür ve düşünceyi kapsamaktadır. İkinci bölümünde on dokuz farklı ülkenin anayasası incelenmiştir. Bu inceleme sadece lafzen ve anayasalarda geçen cümlelerden ibarettir. Üçüncü ve son kısımda ise Türk Anayasa Tarihi ve Türkiye Cumhuriyeti Anayasalarında Devletin Amacı aranmıştır.

In the first part, a historical evaluation was made regarding the question of what is the purpose of the State.This historical evaluation covers 21 different thinkers and thoughts with three subheadings: The Purpose of the State in the Ancient Greek and Roman Empire, The Purpose of the State in Medieval Europe and the Birth of the Modern State, The Purpose of the Commonwealth in Turkish - Islamic Civilization and Governance Thought. In the second part, the constitutions of 19 different countries were examined. This review consists only of the words and the sentences in these constitutions. In the third and last part, the purpose of the state in the history of the Turkish Constitution and the Constitutions of the Republic of Turkey is sought.
