Üreticinin ayıplı malın sebep olduğu zararlardan sorumluluğu

Abstract

AB Konseyi'nin 25 Temmuz 1985 tarihli 85/374/AET sayılı Direktifi ile üreticiye ayıplı malın sebep olduğu zararlar nedeniyle kusursuz sorumluluk getirilmiştir. Mevzuatımızın AB mevzuatı ile uyumlu olması hedeflendiğinden, 12 Mart 2021 tarihinde yürürlüğe girecek olan 7223 sayılı Ürün Güvenliği ve Teknik Düzenlemeler Kanunu'nda üreticinin sorumluluğuna ilişkin hükümler Direktif'te yer alan hükümleri esas almıştır. Bu çalışma ile amaçlanan, üreticinin ayıplı malın sebep olduğu zararlardan sorumluluğu konusunun mevcut düzenlemeler, 12 Mart 2021 tarihinde yürürlüğe girecek olan 7223 sayılı ÜGTDK ve 85/374 sayılı AB Konsey Direktifi kapsamında incelenmesidir.

The Council Directive 85/374/EEC of 25 July adopts liability without fault of the producer for damages caused by defective product. As it is aimed to harmonize our legislation with EU legislation, the provisions regarding the producer's responsibility in the Product Safety and Technical Regulations Code No. 7223 which will enter into force on March 12, 2021, are based on the provisions of the The Council Directive 85/374/EEC of 25 July.
