Temel hak ve hürriyetlerin sınırlandırılmasının sınırı üzerine bir araştırma: Türk Anayasa Mahkemesi kararları üzerine bir değerlendirme

Özet

Bu çalışma 1961 ve 1982 anayasaları döneminde Türk Anayasa Mahkemesi'nin temel hak ve özgürlüklere yönelik anlayışını inceleme amacı taşımaktadır. Tarihte yasa, doğal hukuk, adalet ve kamu yararı gibi kavramların yönetenlerin sınırlandırılması kıstasları olarak tartışıldığı görülmüştür. Günümüz modern devlette de devlet iktidarının sınırlandırılmasına dair tartışmalar devam etmektedir. Dolayısıyla bu tartışmaların odağında olan anayasacılık hareketlerinin tarihi yeni değildir. Temel hak ve özgürlüklerin anayasal güvenceye kavuşturulmasında şüphesiz en önemli unsur bireyi devlete karşı korumaktır. 1961 Anayasası güçlü bir temel hak ve özgürlükler rejimi getirmiştir. Fakat norm denetimi yetkisini kullanan Anayasa Mahkemesi'nin yasakçı kararları söz konusu olmuştur. 1982 Anayasası ise devlet-birey ilişkilerinde devleti öncelemiştir. 1961 Anayasası'nda hak ve özgürlüğün serbestliği esas iken 1982 Anayasası'nda sınırlılığın esas alındığı görülmektedir. Temel hak ve hürriyetlerin korunması kadar hukuk düzenin korunması da anayasanın korunması anlamına gelir ve bu da hukuk devleti açısından önem taşımaktadır. Anayasa ve anayasal düzenin koruyucusu olan AYM'nin de bu noktada kararları önemli konumdadır. Hukuk devleti açısından yüksek mahkemenin salt "Anayasada gösterilen hürriyetçi demokrasiyi" değil, "çağdaş özgürlükçü demokrasiyi" savunması beklenmektedir. Denetim erki olan AYM'nin yürürlükteki Anayasa'nın yanında ayrıca evrensel hukuk ilkelerini de kaynakları arasında uygun bir donanım haline getirmiş olması gerekir. Sadece Anayasa metnine aykırılıktan ziyade evrensel insan hakları ve evrensel hukukun ilkelerine bağlı bir Anayasa Mahkemesi'nin varlığı, devlet iktidarının hakikaten sınırlandırılmasını da beraberinde getirir. Nihayetinde hukuk devleti ve Anayasa'nın üstünlüğünü sağlama denetiminin asli hedefi yurttaşlara hukuki güvence sağlamaktır. AYM kararlarında insan haklarını koruyan ve geliştiren bir devlet anlayışını görmek gerekir. Başka bir ifadeyle, hak temelli insan hakları anlayışıyla hukukun üstünlüğü ve hukuk devleti sağlanmış olacaktır.

This study aims to analyze the Turkish Constitutional Court's understanding of fundamental rights and freedoms during the 1961 and 1982 Constitutions. Historically, concepts such as law, natural law, justice and public interest have been discussed as criteria for limiting rulers. In today's modern state, debates on the limitation of state power continue. Therefore, the history of the constitutionalist movements at the center of these debates is not new. Undoubtedly, the most important element in the constitutional guarantee of fundamental rights and freedoms is to protect the individual against the state. The 1961 Constitution introduced a strong regime of fundamental rights and freedoms. However, there have been prohibitive decisions of the Constitutional Court exercising its norm review power. The 1982 Constitution prioritized the state in state-individual relations. While the 1961 Constitution was based on the freedom of rights and freedoms, the 1982 Constitution is based on limitations. The protection of the rule of law, as well as the protection of fundamental rights and freedoms, means the protection of the constitution and this is important for the rule of law. The decisions of the Constitutional Court, as the guardian of the Constitution and the constitutional order, are also important at this point. In terms of the rule of law, the Supreme Court is expected to defend not only "the libertarian democracy enshrined in the Constitution" but also "contemporary libertarian democracy". The Constitutional Court, as the supervisory power, should also have universal principles of law as an adequate source in addition to the Constitution in force. The existence of a Constitutional Court that adheres to universal human rights and the principles of universal law, rather than merely contradicting the text of the Constitution, brings with it a real limitation of state power. Ultimately, the primary objective of the rule of law and the supervision to ensure the supremacy of the Constitution is to provide legal guarantees to citizens. It is necessary to see in the Constitutional Court's decisions an understanding of a state that protects and promotes human rights. In other words, a rights-based understanding of human rights will ensure the rule of law and the rule of law.
