Osmanlı-Türk anayasalarında egemenlik anlayışı (1876-1961)

Abstract

Siyaset biliminin önemli ve tayin edici konularından biri olan egemenlik anlayışı ve bunun yansıması, Osmanlı-Türk anayasaları bağlamında konu edinilerek yaşanılan değişimler sebepleri ile beraber incelenmiştir. Osmanlı-Türk tarihinin ilk anayasası olan Kanun-ı Esasi ile başlayan değerlendirmemiz, bu anayasadaki 1909 değişiklikleri, bir geçiş anayasası olarak 1921 Anayasası ve cumhuriyet devrinin ilk anayasası olan 1924 Anayasası ile devam etmiş ve 1961 Anayasası ile sonlanmıştır. Bu anayasalarda devlet ve organları, hükümdar veya devlet başkanı ve halkın birbirlerine karşı olan konumlanışı, egemenlik anlayışlarının da yansıması olarak bizzat anayasa maddeleri üzerinden veya bununla ilgili belgelerden takip edilmiştir.

The research examines the concept of sovereignty, which is one of the most important subjects in political science, and the causes of constitutional revisions in Ottoman-Turkish history. Starting with Kanun-ı Esasi, the first constitution of Ottoman-Turkish history, as well as 1909 changes in this constitution, and the 1921 constitution as a transitional constitution, continuing with the 1924 constitution, which was the first constitution of the republic era, our assessment ends with the constitution of 1961. To reflect on the concept of sovereignty, the roles of the state and its institutions, the ruler and people, the study analyzes constitutional articles and other related sources.
