In the Turkish legal system, it is declared that employees shall be protected before employers because of their weak positions. As a consequence of this, a set of legal provisions has been regulated with Turkish legal legislations and one of the critical legal provisions providing this protection is the employment security. Not every employee, but only some employees are taken into the scope of employment security with current legal provisions. Only employees who have conditions specified by Labour Code numbered 4857 shall be deemed as being in the scope of employment security. The reason to exclude some employees from the scope of employment security is the purpose of labour law to find a fair balance between an employee and an employer. Indeed, employment security does not mean leaving employers completely unprotected while protecting employees. With provisions of employment security, it is aimed to prevent termination of employment contracts of employees from employers’ arbitrary terminations. Therefore, some specific procedures while terminating employment contracts of employees being in the scope of employment security are determined by Labour Code numbered 4857 such as issuing a warning before termination and issuing termination notice in written form. Due to the importance of employment security both for employees and employers; in this thesis; provisions of employment security regulated in Turkish Labour Law shall be studied, it shall be evaluated which employees shall be considered to be in the scope of employment security, it shall be declared that being in the scope of employment security provides what kind of protections and in conclusion, it shall be discussed which measures shall apply in case of a violation of provisions of employment security. Keywords: Employment Security, Employer, Employee, Arbitrary Termination, Valid Reason, Reemployment Case, Reemployment Compensation.
