Türkiye'de kamu denetçiliği kurumu'nun etkinliği

Abstract

Modern anlamda ilk kez 1809 yılında İsveç'te uygulanmaya başlayan ombudsman kurumu, özellikle II. Dünya Savaşı'ndan sonra dünyada hızla yayılmaya başlamıştır. Ombudsman kurumunun hızla yayılmaya başlamasında, İsveç'te başarılı bir şekilde uygulanması ve geleneksel denetim mekanizmalarının idareyi denetlemede yetersiz kalması sonucunda yeni bir denetim mekanizması ihtiyacı duyulması etkili olmuştur. Çalışmada, öncelikle ombudsman kurumu hakkında temel bilgiler verilmiştir. Ombudsmanın etkin bir şekilde işleyişine örnek oluşturması amacıyla İngiltere, Hollanda ve Fransa ülke ombudsman uygulamaları ve uluslararası düzeyde tek ombudsman olan Avrupa Ombudsmanı ele alınmıştır. Çalışmanın amacı Türkiye'de Kamu Denetçiliği Kurumu'nun Etkinliği'nin analiz edilmesidir. Bu nedenle öncelikle kurumun oluşturulmasına yönelik çalışmalar, kurumun yapısal ve işlevsel yönleri incelenmiştir. Son olarak, Kamu Denetçiliği Kurum'un etkinliği, kurumun 2013- 2017 arasındaki yıllık raporları incelenerek analiz edilmiş ve kurumun etkinliğinin arttırılmasına yönelik çeşitli önerilere yer verilmiştir. Çalışmanın sonucunda, Kamu Denetçiliği Kurumu'nun önceki yıllara oranla etkinliğinin arttığı; ancak bu artışın Avrupa ombudsmanlarına göre yeterli düzeyde olmadığı görülmüştür.

The ombudsman institution which started to be applied in Sweden in the 19th century for the first time in modern sense, After World War II, the ombudsman began to spread rapidly adound the world. The reasons of the ombudsman's rapid spread has been influenced by the need for a new control mechanism and it has been successfully implemented in Sweden. Traditional control mechanisms is insufficient to supervise the management. Firstly, basic information was given about the ombudsman institution in the study. The UK, Netherlands, France parliamentary ombudsman and European Ombudsman practises were considered as examples of how the ombudsman works effectively. The aim of this study is to analyze the ombudsman's institution in Turkey. For this reason, firstly about the establishment of the Ombudsman Institution, the structural and functional aspects of the Ombudsman Institution in Turkey were examined. Finally, the effectiveness of the Ombudsman Institution was analyzed by analyzing the institution's annual reports for 2013-2017. As a result, there were various proposals for increasing the effectiveness of the institution. As a result of the work, it seems that the effectiveness of the Ombudsman Institution was increased compared to previous years. However, it seems that the institution's effectiveness was not at a sufficient level with respect to European ombudsman.
