Özet
Bu tez çalışması, barış çalışmalarının önemine odaklanarak, barış hakkının kavramsal çerçevesini uluslararası barış ve güvenlik bağlamında ele alarak, daha barışçıl bir düzen nasıl sağlanabilir sorusuna barış hakkı çerçevesinde bir cevap aramayı hedeflemiştir. Barış hakkı, esasında toplumların barış ve güvenlik içinde yaşama hakkını temsil eden bir 'insan hakkı' olarak anılagelmektedir. Özü itibariyle barışın korunması, sağlanması ve sürdürülebilir olması anlamını taşıyan barış hakkının çerçevesi bununla sınırlı değildir. Bu tezde barış hakkı, aynı zamanda, güvenlik, nükleer silahsızlanma, çatışmaların barışçıl çözümü, sosyal adalet ve küresel adaletin sağlanması unsurlarını da kapsayan bir hak olarak ele alınmıştır. Barış hakkının kavramsal boyutu ortaya konulurken, onun uluslararası barış ve güvenlik ile olan ilişkisi jus ad bellum kapsamında incelenmeye çalışılmıştır. Bu doğrultuda, bu çalışmamızda, BM Güvenlik Konseyi'nin verdiği yetkiye ve Koruma Sorumluluğu ilkesine dayanarak, görünürde hem vahim insan hakları ihlallerine son vermek hem de Libya'da barış ve güvenliği tesis etmek amacıyla 2011 yılında Libya'ya NATO eliyle gerçekleştirilmiş olan müdahalenin yapılış biçimi ve yol açtığı sonuçların, barış hakkının muhtevasıyla tutarlı olup olmadığını ortaya koymayı amaçlamıştır. Başka bir deyişle, burada, BM Güvenlik Konseyi'nin yetki verdiği Libya müdahalesinde, barış hakkının ne ölçüde hayata geçirildiği hususu inceleme konusu yapılmıştır. Günümüzde hâkim olan 'barış' anlayışının savaşlara, çatışmalara, askeri saldırılara ve ağır insan hakları ihlallerine çözüm getirmedeki yetersizliği karşısında, mevcut uluslararası düzeni barış yelpazesinden eleştirel bir şekilde ele alınmasını gerekli hale getirmiştir. Bu doğrultuda, bu tezde, Uluslararası Hukuka Üçüncü Dünyacı Yaklaşımların (Third World Approaches to International Law: TWAIL) bizlere sunmuş olduğu eleştirel zeminden faydalanılarak, yeni-sömürgeciliğin ve emperyalist tasallutun barışçıl bir uluslararası düzenin önündeki başlıca engeller olarak temel araçlarını ve unurularını ortaya koymayı amaçlamıştır. İçinde bulunduğumuz sömürgecilik-sonrası dönemde, hâkim uluslararası düzenin önde gelen aktörünün Batılı hegemonlar olarak 'ben' ile Batılı olmayan ezilenler olarak 'öteki' arasında bir ayrım yaparak, bunun uluslararası barış ve güvenliğin tesis edilmesinde 'adalet', 'eşitlik' ve 'hakkaniyet' ilkelerini baltaladığı ileri sürülmektedir.
By focusing on the importance of peace studies, this thesis aims to seek an answer to the question of how a more peaceful order can be achieved within the framework of the right to peace by addressing the conceptual framework of the right to peace in the context of international peace and security. The right to peace is essentially referred to as a 'human right' that represents the right of societies to live in peace and security. The framework of the right to peace, which essentially means the protection, establishment, and sustainability of peace, is not limited to this. The right to peace is also addressed as a right that includes elements such as security, nuclear disarmament, peaceful resolution of conflicts, social justice, and the provision of global justice. While the conceptual dimension of the right to peace is being presented, its relationship with international peace and security is examined within the boundaries of jus ad bellum. In this context, based on the authority granted by the UN Security Council, the thesis looks at the manner in which the intervention, in reliance of the principle of the Responsibility to Protect, was carried out in Libya in 2011, ostensibly in order to put an end to grave human rights violations and to establish peace and security in Libya. This study thus seeks to find out as to whether or not the Libyan operation and its consequences have been consistent with the content of the right to peace. In other words, this thesis endeavors to shed light on the question of whether the right to peace was properly implemented in the Libyan intervention which was authorized by the UN Security Council. In the face of the inadequacy of today's dominant understanding of 'peace' in bringing about solutions to wars, conflicts, military aggressions and grave human violations, it has become necessary to critically address the current international order from the spectrum of peace. To this end, through benefiting from the critical ground provided to us by Third World Approaches to International Law (TWAIL), this thesis has sought to reveal the main vehicles and elements of neo-colonialism and imperialist domination as main obstacles to a peaceful international order. In the existing post-colonial era, we are witness to the leading actor of the dominant international order making a distinction between the 'self' as the Western hegemons and the 'other' as the non-Western oppressed. This, it is argued, undermines, the principles of 'justice', 'equality' and 'fairness' in the establishment of international peace and security.
