Deniz sigortalarında sigortalanabilir menfaat ilkesi

Abstract

Bu çalışmada 6102 sayılı Türk Ticaret Kanunu çerçevesinde sigortalanabilir menfaat ilkesinin deniz sigortalarına özgü görünümlerinin incelenmesi amaçlanmaktadır. İnceleme kapsamında Türk hukukunun yanı sıra, İngiliz hukukunda konunun hukuki dayanağını teşkil eden 1906 tarihli Marine Insurance Act hükümleri gerekli görüldüğü ölçüde karşılaştırmalı olarak değerlendirilmiştir. Çalışmada menfaat kavramı, sigortalanabilir menfaat ilkesinin genel esasları, tarihsel gelişimi ve önemi; deniz sigortasının tanımı, tarihsel gelişimi ve temel türleri; deniz sigortalarında sigortalanabilir menfaatin hukuki dayanakları, bulunması gereken zaman ve görünümleri sistematik olarak incelenmiştir.

The aim of this study is to examine the manifestations specific to marine insurance of the insurable interest principle within the framework of the Turkish Commercial Code No. 6102. In addition to Turkish law, the provisions of the 1906 Marine Insurance Act, which constitute the legal basis of the subject under English law, have been comparatively evaluated to the extent deemed necessary. The study systematically examines the concept of interest, the general principles, historical development and significance of the insurable interest principle; the definition of marine insurance, its historical development and main types; as well as the legal foundations, the required time of existence and the manifestations of insurable interest in marine insurance.
