dc.description.abstractBu çalışma, Robinsonad türüne ait üç temel eser — Hay bin Yakzan, Robinson Crusoe ve Cuma ya da Pasifik Arafı — üzerinden insan doğasına ilişkin farklı yaklaşımların, insan hakları ve mülkiyet hakkı üzerindeki etkilerini incelemeyi amaçlamaktadır. Devletin ve pozitif hukukun bulunmadığı koşullarda, bireyin diğer insanlarla, doğayla ve nesnelerle kurduğu tahakküm ilişkileri, hem hukuk hem de edebiyat perspektifinden analiz edilmiştir. Bu çerçevede, iki disiplinin sınırlarına riayet edilerek, edebi eserlerde yer alan hukuki kavramların çözümlemesini esas alan "edebiyatta hukuk" yaklaşımı benimsenmiştir. İnsan hakları bağlamında köleleştirme, sömürgecilik ve mülkiyet gibi kavramların yanı sıra, hayvanlara yönelik ahlaki sorumluluklarımızın sınırlarının nasıl belirlenebileceği sorusu, klasik hukuk yaklaşımlarının ötesine geçilerek, edebiyatın sunduğu imkânlarla yeniden değerlendirilmiştir. Çalışma, metinlerarası bir yöntemle söz konusu eserler arasında karşılaştırmalı bir analiz gerçekleştirmiş; kavramsal dönüşümler ve eserlere özgü farklı yaklaşımlar ortaya konulmuştur. Bu bağlamda, insan doğasını bireyci ve çıkar temelli bir varlık olarak tanımlayan Homo economicus ile onu işbirlikçi ve yardımsever niteliklerle ele alan insan anlayışları karşılaştırılmış; bu yaklaşımların bireyin insanlarla, doğayla ve hayvanlarla kurduğu ilişkiler üzerindeki etkileri değerlendirilmiştir. Ayrıca, insan doğasının mahiyetine dair çeşitli örnekler üzerinden yürütülen tartışmalarla, bu doğaya daha uygun bir hukuk sisteminin imkânları araştırılmıştır. Sonuç olarak, işbirliğine ve yardımseverliğe dayalı bir insan doğası tasavvurunu merkeze alan bu çalışma, Homo economicus modelinin çevresini araçsallaştıran ve tahakküm kuran karakterinin, doğa ve toplumla olan sorunlu ilişkilerini analiz etmiş; nihayetinde Homo economcus’un sınırlarının ve sorumluluklarının tekrar düzenlenebilmesini olanaklı kılan bir hukuk anlayışına kapı aralamıştır.
dc.description.abstractThis study examines how different approaches to human nature affect human rights and property rights through three key works of the Robinsonade genre — Hayy ibn Yaqzan, Robinson Crusoe, and Friday, or, The Other Island. In the absence of state and positive law, the relations of domination established by the individual with other humans, nature, and objects are analyzed from both legal and literary perspectives. Within this framework, and respecting the boundaries of both disciplines, the study adopts the "law in literature" approach, which focuses on analyzing legal concepts embedded in literary works. Concepts such as enslavement, colonialism, and property, in the context of human rights, are re-evaluated through the interpretive possibilities of literature, going beyond classical legal approaches — including the question of how to determine the limits of our moral responsibilities toward animals. Using an intertextual method, the study conducts a comparative analysis of the selected texts, revealing conceptual shifts and unique approaches. It contrasts the idea of human nature as Homo economicus — individualistic and self-interested — with understandings that view humans as cooperative and benevolent. It assesses how these views influence human relationships with others, nature, and animals. Furthermore, through various examples about the nature of humanity, the study explores the potential for a legal system better suited to that nature. Ultimately, centering on a vision of human nature based on cooperation and benevolence, this study analyzes the Homo economicus model’s instrumental and dominating traits, and its problematic ties with nature and society. It concludes by opening the door to a legal understanding that enables rethinking the limits and responsibilities of Homo economicus.
