Oyak'ın sivil toplum kuruluşu olarak incelenmesi ve dünyadaki benzer kuruluşlarla kıyaslaması

Abstract

Ordu yardımlaşma kurumu, Türk Silahlı kuvvetleri mensuplarının emekli ve yardımlaşma fonu olarak tanımlanmaktadır. Ordu Yardımlaşma Kurumunun temel amacı dayanışma ve yardımlaşmayı sağlamaktır. Amerika, İngiltere ve Kanada gibi mesleki fonlarla karşılaştırıldığında sağladığı hak ve imkânlarla bu ülkelerle iyi bir düzeydedir. Ordu Yardımlaşma Kurumu'nun organları 205 sayılı yasanın 2.maddesinde verildiği gibi; Temsilciler Kurulu, Genel Kurul, Yönetim Kurulu, Denetleme Kurulu ve Genel Müdürlüktür. OYAK, 205 sayılı Kanun ile Genel Kuruldan alınan kararların sonucunda üyelere iki çeşit yardım sağlamaktadır; yasal (zorunlu) yardımlar ve sosyal hizmetler. Üyelerin almış olduğu zorunlu yardımlar şu şekildedir; Emeklilik yardımı, Üye vefatı durumunda yapılan yardımlar, Maluliyet yardımı, Rezerv karşılığında %80 borç verme hizmeti, Yedek subay hizmet süresinin birleştirilmesi, Hizmet İhyası. Üyelerin almış olduğu sosyal hizmetler ise şu şekilde sıralanmaktadır; Borç verme hizmeti, Bağışa Dayalı Emekli Geliri Sistemi (BDEGS), Emekli Maaşı Sistemi (EMS), Konut Ön Biriktirim Fonu (KÖBF), OYAK Sağlık Platformu Hizmetleri. Sivil toplum kavramı ilk olarak, siyasi toplum ile paralel ele alınmıştır. Ordu ve Yardımlaşma Kurumu, hükümet dışı bir oluşum olduğu için, sivil toplum bağlamında incelenebilir. Ordu ve Yardımlaşma Kurumu'nun kar amacı gütmemesi, aynı zamanda sivil toplum özelliğidir. OYAK dünya askeri emeklilik sistemleri, OYAK benzeri sistemlerle karşılaştırıldığında onlarla rekabet edebilecek pozisyonda, bazı özellikleri ile ise daha ön plandadır.

The Army Assistance Institution is defined as the pension and mutual aid fund of the members of the Turkish Armed Forces. The main purpose of the Army Assistance Institution is to provide solidarity and cooperation. Compared to professional funds such as the United States, Britih and Canada, it is at a good level with these countries with the rights and opportunities it provides. The organs of the Army Assistance Institution are as given in Article 2 of Law No. 205; The Board of Representatives, the General Assembly, the Board of Directors, the Supervisory Board and the General Directorate. As a result of the decisions taken by the General Assembly with Law No. 205, OYAK provides two types of assistance to its members; statutory (mandatory) benefits and social services. The mandatory aids received by the members are as follows; Retirement benefits, Benefits in the event of the death of a member, Disability benefit, 80% lending service against the reserve, Consolidation of reserve officer service period, Service Restoration. The social services received by the members are listed as follows; Lending service, Donation-Based Pension Income System (BDEGS), Pension System (EMS), Housing Pre-Savings Fund (KÖBF), OYAK Health Platform Services. The concept of civil society was first discussed in parallel with political society. Since the Army and Assistance Institution is a non-governmental entity, it can be examined in the context of civil society. The fact that the Army and Assistance Institution is not for profit is also a feature of civil society. Compared to military retirement systems around the world and similar systems to OYAK, it is positioned to compete with them and stands out with some of its features.
