Evaluations on the Indirect Protection of Social and Economic Rights Through the European Convention on Human Rights

Abstract

The European Convention on Human Rights (ECHR) guarantees fundemantal rights. The European Court of Human Rights (ECtHR) has arbitrated disputes regarding social and economic rights in a sizable number of instances. When the ECtHR’s case law is considered, it varies from the regime used for civil and political rights, as it comes to social and economic rights, by avoiding making an assessment of the right that is the subject of the application, it is determined if the fair balance that is anticipated to be achieved between the interests of society and the individual is in place. Nonetheless, it should be highlighted that the ECtHR continues to uphold social and economic rights under the ECHR while maintaining its stance on basic rights. In this context, the ECHR’s protections for the right to a fair trial and against discrimination are occasionally used. In this way, the ECHR also discusses social and economic rights in relation to other rights. The study concentrates on whether the ECHR can be used to defend social and economic rights in this context.

Avrupa İnsan Hakları Sözleşmesi (AİHS) esas olarak temel hakları güvence altına almıştır. Bununla birlikte Avrupa İnsan Hakları Mahkemesi (AİHM) kayda değer sayıda davada, sosyal ve ekonomik haklara ilişkin uyuşmazlıkları çözüme kavuşturmuştur. AİHM içtihadı incelendiğinde, sosyal ve ekonomik haklar alanında medeni ve siyasi haklara uygulanan rejimden farklı olarak, başvuruya konu hakka ilişkin değerlendirme yapmaktan kaçınılarak, doğrudan toplum ile bireyin çıkarları arasında olması beklenen adil dengenin kurulup kurulmadığı test edilmektedir. Bununla birlikte AİHM, sosyal ve ekonomik hakları AİHS kapsamında korurken, temel haklara ilişkin perspektifini kullanmayı sürdürmektedir. Bu doğrultuda, kimi zaman adil yargılanma hakkı ve ayrımcılık yasağı gibi AİHS hükümlerine başvurulmakta, ayrıca sosyal ve ekonomik haklar AİHS’te yer alan diğer haklarla ilişkisi üzerinden ele alınmaktadır. Çalışmada, sosyal ve ekonomik hakların, AİHS yoluyla korunma imkânı üzerinde durulmaktadır.
