Yeni Öğretmenlik Meslek Kanunu teklifi ve Millî Eğitim Akademisi’nin kurulmasına dair

Abstract

Yürürlükteki Öğretmenlik Meslek Kanunu, Anayasa Mahkemesinin bazı maddeleri iptal etmesi ve revizyon talebi üzerine yeni ve daha kapsamlı bir kanun teklifi olarak TBMM’ye sunulmuş ve yasalaşmak üzeredir. Bu makalede yeni Öğretmenlik Meslek Kanunu Teklifi ile aynı kanunla kurulması amaçlanan Millî Eğitim Akademisi’nin Türk eğitim sistemi ve öğretmenlik mesleği bakımından etkililiği ve işlevselliği değerlendirilmiştir. Millî Eğitim Bakanlığı (MEB), mevcut yasayı revize etmek yerine yeni bir yasa taslağı hazırlamayı tercih etmiştir. Yeni ÖMK, mesleğin gelişen ihtiyaçlarına cevap vermeyi amaçlamakta, ancak öğretmenlik mesleğinin profesyonel ve kurumsal bütünlüğünü zayıflatma potansiyeli nedeniyle eleştirilerle karşılaşmaktadır. Yeni ÖMK'nın ve kurulması amaçlanan Millî Eğitim Akademisi'nin kapsamının, olumlu ve olumsuz yönlerinin ve potansiyel etkilerinin incelendiği bu yazıda, yasanın bu haliyle yeni tartışma ve çatışmalara yol açacağı öngörüsü savunulmaktadır.The current Teaching Profession Law (TPL) has been submitted to the Turkish Grand National Assembly (TBMM) as a new and more comprehensive bill law following the annulment of some articles by the Constitutional Court and the request for revision. This article evaluates the effectiveness and functionality of the new TPL Bill and the National Education Academy, which is intended to be established by the same law, in terms of the Turkish education system and the teaching profession. The Ministry of National Education (MoNE) preferred to draft a new law rather than revise the existing one. The new TPL aims to meet the evolving needs of the profession, but it has faced criticism for potentially weakening the professional and institutional integrity of the teaching profession. This article examines the scope, advantages and disadvantages, and potential impacts of the new TPL and the proposed National Education Academy, arguing that the current form of the law will lead to new debates and conflicts.
