LABOR DISPUTE-DISAGREEMENTS IN THE HIGH BOARD OF ARBITRATION DECISIONS

Abstract

In the institution that is the subject of our study, although the parties have no prior consent and commitment to go to the arbitrator, in cases stipulated in the law, the dispute is necessarily taken to the Supreme Arbitration Board with the application of one party. The regular arbitral institution resolves an existing dispute between the parties and this carries a judicial function. However, in the application of compulsory arbitration in collective labor disputes, the arbitrator performs the legislative function by resolving the conflict of interests between the parties by setting new rules

Çalışmamıza konu olan müessesede, tarafların hakeme gitme konusunda önceden hiçbir rıza ve taahhütleri bulunmamasına rağmen kanunda öngörülen durumlarda zorunlu olarak bir tarafın müracaatı ile uyuşmazlık hakem olarak Yüksek Hakem Kuruluna götürülmektedir. Normal hakem müessesi taraflar arasında mevcut bir hak uyuşmazlığını çözer ve bu durum kazai bir fonksiyon taşır. Hâlbuki toplu iş uyuşmazlıklarında zorunlu hakemde, hakem taraflar arasındaki menfaat uyuşmazlığını yeni kurallar koyarak çözerek bir nevi yasama fonksiyonu icra etmektedir
