Yapı bilgi modelleme sistemi (BIM) ve dijital ikiz uygulamalarının hukuki boyutu

Abstract

İnşaat ve bilgi teknolojileri konusunda elde edilen hızlı gelişmeler, inşaat, mimarlık ve mühendislik sektöründe yeni anlayışları ve pratikleri zorunlu kılmaktadır. Ne yazık ki bazı ülkelerin bu anlamda yeterli ölçüde hızlı teknik ve yasal altyapı dönüşümünü sağladığı söylenememektedir. Gelişen dünyada yapı bilgi modelleme (BIM) yaklaşımı ile yönetilen proje süreci, entegre teknolojiler vasıtasıyla dijital ikize doğru evrilmektedir. Türkiye ise BIM kullanımı konusunda henüz bulunması gereken noktada değildir. Öncü ülkeler hem BIM hem de dijital ikiz uygulamaları noktasında belirli mesafeler katetmiş ve gerekli yasal düzenlemeleri hayata geçirilmiş durumdadır. İnşaat sektörünün büyük bir global sektör olması bu gelişmelerin diğer ülkelerde de hızla uygulanmasını zorunlu kılmaktadır. Hukuki altyapı hazırlanmadan ve gerekli regülasyonlar yapılmadan BIM kullanımının artmasını beklemek faydasızdır. Bu konuda yasal bir çerçeve oluşturmadan önce mevzuattaki eksikliklere ve sektördeki paydaşların akdedeceği sözleşmelerde dikkate alması gereken hususlara işaret etmek gerekir. Dijital çağda her yeni gelişmede olduğu gibi, BIM kullanımı da teknik ve yasal sorunları beraberinde getirmektedir. Bu nedenle bu çalışmada BIM kullanımıyla oluşabilecek yasal sorunlar ve bu konuda yayınlanan standart sözleşmelere ve ek protokol hükümlerine yer verilecektir. BIM protokollerinin Türk mevzuatı çerçevesinde hukuki niteliğine ilişkin bir değerlendirme yapılarak doğabilecek ihtilaflarda hangi hükümlerin uygulanacağı belirlenecektir. BIM'in yapının dijital ikizlerini oluşturma sürecinde sağlam bir veri kaynağı olması nedeniyle BIM'den kaynaklanan sorunların dijital ikizi etkilemesi kuvvetle muhtemeldir. Dijital ikiz uygulamaları günümüzde sınırlı sayıdadır ve bu konuda standardizasyon çalışmaları halen yürütülme aşamasındadır. Dijital ikizler konusunda literatürde yer alan çalışmalar çoğunlukla tanımlar ve işlevler üzerine olduğu için çalışmamızda dijital ikiz kullanımıyla ortaya çıkabilecek sorunlara bir bulgu olarak atıf yapılacaktır.Rapid developments in construction and information technologies necessitate new understandings and practices in the construction, architecture and engineering sec-tors. Unfortunately, it cannot be said that some countries have achieved suffici-ently rapid technical and legal infrastructure transformation in this sense. In the developing world, the project process managed with the BIM approach is evolving towards a digital twin through integrated technologies. Türkiye, on the other hand, is not yet at the point it should be in terms of BIM use. Leading countries have ma-de progress in terms of both BIM and digital twin applications and have imple-mented the necessary legal regulations. The fact that the construction industry is a large global sector necessitates the rapid implementation of these developments in other countries. It is useless to expect the use of BIM to increase without preparing the legal infrast-ructure and making the necessary regulations. Before creating a legal framework on this subject, it is necessary to point out the deficiencies in the legislation and the issues that stakeholders in the sector should take into account in the contracts they will conclude. As with every new development in the digital age, the use of BIM brings technical and legal problems. For this reason, this study will include the le-gal problems that may arise with the use of BIM and the standard contracts and additional protocol provisions published on this subject. An evaluation will be made regarding the legal nature of BIM protocols within the framework of Turkish legislation and it will be determined which provisions will be applied in case of disputes that may arise. Since BIM is a reliable data source in the process of crea-ting digital twins of the structure, it is highly likely that problems arising from BIM will affect the digital twin. Digital twin applications are limited in number today and standardization studies on this subject are still in the process of being carried out. Since the studies in the literature on digital twins are mostly about definitions and functions, the problems that may arise with the use of digital twins will be ci-ted as a finding in our study.
