LES ACCORDS DE PROMOTION ET DE PROTECTION DES INVESTISSEMENTS ÉTRANGERS SIGNÉS PAR LA TURQUIE

Abstract

Les investissements étrangers sont considérés comme étant un outil important et nécessaire pour réaliser les objectifs de développement et de croissance économique des pays. Les pays se font concurrence pour attirer le plus d’investissements étrangers, qui est leur est bénéfique à plusieurs égards. Pour attirer les investisseurs étrangers et leur assurer un cadre sûr, nombreux sont les pays qui signent des accords de promotion et de protection des investissements étrangers. C’est dans cette optique qu’il y a, d’une manière générale, une prolifération accords bilatéraux de promotion et de protection des investissements étrangers, qui est considéré comme étant un des éléments qui rassurent et attirent les investisseurs. Dans cet article nous allons nous intéresser aux accords de promotion et de protection des investissements étrangers conclus par la Turquie. Pour ce faire, nous étudierons dans une première section ces accords d’une manière générale pour avoir une vue d’ensemble. Nous évoquerons leur apparition, leurs objectifs et les modèles qui existent. Nous analyserons ensuite dans une seconde section ceux conclus par la Turquie en faisant un état des lieux des investissements étrangers, en mentionnant les pays avec lesquels la Turquie a conclu de tels accord et en étudiant en détail les dispositions des accords en question.

Foreign investment is seen as an important and necessary tool to achieve the development and economic growth objectives of the countries. Countries compete with each other to attract most of the foreign investment, which benefits them in several ways. To attract foreign investors and provide them with a secure environment, many countries have signed agreements to promote and protect foreign investments. It is from this perspective that there is, in general, a proliferation of bilateral agreements for the promotion and protection of foreign investment, which is considered to be one of the elements that reassure and attract investors. In this article we will focus on foreign investment promotion and protection agreements concluded by Turkey. In order to do so, we will study in the first section, these agreements in a general way in order to have an overview. We will discuss their emergence, their objectives and the models that exist. We will then analyze in the second section those concluded by Turkey by taking stock of the foreign investment situation, mentioning the countries with which, Turkey has concluded such agreements and studying in detail the provisions of the agreements in question.
