KÜRESEL COVİD-19 SALGINI’NIN TÜRK BİREYSEL İŞ HUKUKUNA ETKİSİ

Abstract

Covid-19 salgın hastalığı nedeni ile çok sektörde ekonomik daralmakta, işyerlerinde faaliyet durdurulmakta ve yine birçok işçinin çalıştığı işyerlerinde küçülmeler meydana gelme ihtimali de ortaya çıkmaktadır. Bu nedenle ekonomik sıkıntı çeken ve daralma meydana gelen işverenlerin hukuka uygun olarak ve işçi haklarına zarar vermeden başvurabileceği imkânların doğru şekilde kullanılabilmesi önemlidir . Covid-19 hadisesinin Türk İş Hukuku üzerinde doğurduğu veya doğurabileceği etkiler ve ileri vadedeki muhtemel sonuçları önemlidir. Salgın hastalığın henüz tedavisinin bulunamamış olması nedeniyle küresel ekonominin içinden geçtiği olumsuz dönemin ülkemiz ekonomisi üzerinde ağır sonuçlar doğurması ihtimal dahilindedir. İstihdam sürekliliğini, yani milyonlarca insanın yaşam koşullarını ve işverenlerin işletmelerinin geleceğini ilgilendiren iş sözleşmelerinin olumsuz etkileneceği aşikârdır.

Due to the COVID-19 epidemic, the economy shrinks in many sectors, activities stop in workplaces and the possibility of downsizing in workplaces where many employees work arises. Hence, it is important for employers, who suffer from economic difficulties and downsizing, to implement practices that are in accordance with the law and that does not harm workers’ rights. The effects of the Covid-19 on Turkish Labor Law and its possible consequences in the future are important. Since there is not yet a cure for the epidemic, it is possible that the negative period that the global economy is going through will have severe consequences on our country’s economy. It is evident that employment contracts that concern the continuity of employment, the living conditions of millions of people and the future of employers’ businesses will be adversely affected.
