HAYSİYETSİZ HAYAT SÜRME NEDENİYLE BOŞANMA

Abstract

Haysiyetsiz hayat sürme nedeniyle boşanmaya hükmolunabilmesi için eşlerden birinin haysiyetsiz bir yaşam tarzı olarak değerlendirilecek fiilleri devamlılık arz edecek bir şekilde kusuru ile işlemesi ve bunun sonucunda diğer eş için evlilik birliğinin devamının beklenemez olması gerekmektedir. Haysiyetsiz hayat sürme sebebiyle boşanma kararı verilebilmesi için gerekli olan unsurlar, haysiyetsiz olarak nitelendirilecek fiiller icra edilmesi, süreklilik, çekilmezlik ve kusurdur. Bu çerçevede haysiyetsiz yaşam sürme olgusunun gerçekleşmesi için gerekli olan söz konusu unsurlar ve haysiyetsiz hayat sürme nedeniyle boşanma ile diğer boşanma halleri arasındaki ilişki iki ana başlık altında ele alınmıştır.

In order for a divorce due to a dishonorable life, one of the spouses must commit acts continuously that will be considered a dishonorable lifestyle with fault and as a result, of the dishonorable lifestyle that adopted spouse, the continuation of the marriage union must not be expected for the other spouse. The necessary elements for a decision to divorce due to adopted dishonorable life are perpetration of dishonorable acts, continuity, unendurableness and fault. In this framework, the factors required for the realization of living a dishonorable life and the relationship between divorce due to leading a dishonorable life and other divorce cases are discussed under two main headings.
