Özet
Bu tez, küresel internet yönetişimi sorununa odaklanarak, bu alandaki mevcut zorlukları ve potansiyel çözüm yollarını incelemektedir. Temel argüman, küresel bir internet yönetişimi sorununun varlığı ve bu sorunun etkin bir hukuk mekanizmasının eksikliği de dahil olmak üzere, birden fazla sorun alanından kaynaklandığı yönündedir. Bu çerçevede, çoklu sorun alanları arasında hukuk, önemli bir bileşen olarak kabul edilirken, tez aynı zamanda teknik, politik ve sosyal boyutları da kapsamlı bir şekilde inceleyecektir. Mevcut literatürde bu sorunların yönetilemezliği üzerine bir konsensüs olsa da, iyi yönetişim ilkelerinin ve normatif unsurların uygulanmasıyla bu sorunların üstesinden gelinebileceği varsayımından yola çıkılmıştır. Bu bağlamda tez, siber uzayın özgün doğasının getirdiği zorluklar karşısında etkin bir yönetişim ve hukuk mekanizmasının mümkün olup olamayacağını değerlendirir. Bu değerlendirme yapılırken, mevcut uluslararası hukuk sisteminin bu yeni ve kaotik ortama adapte olup olamayacağı sorusu da gündeme gelmektedir. Bu bağlamda bu tez, siber uzayın dinamizmiyle uyumlu bir uluslararası siber hukuk modelinin, etkili bir küresel internet yönetişimi için temel bir gereklilik olduğunu öne sürmektedir. Tezde, İnternet Yönetişimi Forumu (IGF) modeli, küresel internet yönetişimi için uygun bir örnek olarak kabul edilmiştir. Ancak IGF, çok paydaşlı yapısı ve kapsayıcı yaklaşımı ile dikkat çekmekte iken; hukuki bağlayıcılığa sahip olmaması -özellikle etkili kararlar alma noktasında- potansiyelini zayıflatmaktadır. Bu noktada tez, normatif teoriyi küresel internet yönetişimi konusunda bir rehber olarak kullanarak, IGF modelinin mevcut sınırlılıklarını aşmaya odaklanmaktadır. Bu doğrultuda tez, IGF'nin daha etkili bir karar alma mekanizmasına sahip olabilmesi için, hukuki bağlayıcılık önerisinde bulunmaktadır. Bu çerçevede geliştirilen normatif ve hukuki çözüm önerileri, hukuki sınırlılıklar dahilinde yapılırken, modelin çok paydaşlı yapısının korunmasına da özen gösterilmiştir.
This thesis focuses on the global internet governance challenge and examines the existing challenges and potential solutions in this area. The main argument is that there is a global internet governance problem and that this problem stems from multiple problem areas, including the lack of an effective legal mechanism. In this framework, while law is recognized as an important component among the multiple problem areas, the thesis will also comprehensively examine the technical, political and social dimensions. While there is a consensus in the existing literature on the unmanageability of these problems, the thesis starts from the assumption that these problems can be overcome through the application of good governance principles and normative elements. In this context, the thesis assesses whether an effective governance and legal mechanism is possible in the face of the challenges posed by the unique nature of cyberspace. This assessment raises the question of whether the existing international legal system can adapt to this new and chaotic environment. In this context, this thesis argues that a model of international cyber law that is compatible with the dynamism of cyberspace is a fundamental requirement for effective global internet governance. In this thesis, the Internet Governance Forum (IGF) model is recognized as an appropriate model for global internet governance. However, while the IGF is noteworthy for its multi-stakeholder structure and inclusive approach, its lack of legally binding nature weakens its potential, especially in terms of effective decision-making. This thesis focuses on overcoming the current limitations of the IGF model by using normative theory as a guide to global internet governance. To this end, the thesis proposes a legally binding mechanism for the IGF to have a more effective decision-making mechanism. While the normative and legal solutions developed in this framework are made within legal limitations, care has been taken to preserve the multi- stakeholder structure of the model.
