Pandemi de hekim hakları

Abstract

ÖZET Bu çalışma günümüz hukuk literatüründe hasta haklarına nazaran geri planda kalan hekim haklarının tespiti, açıklanması ve hekimler için en büyük tehlikelerin yaşandığı pandemi koşulları dâhilinde incelenmesi amaçlarıyla yapılmıştır. Hekimlik insanlık için büyük önem arz eden bir meslektir. Hekimler birey ve toplum sağlığı için hayatlarını riske atmaktadır. Toplum içinde önemli görevler üstlenen hekimler tarih boyunca çeşitli haklara sahip olmuşlarsa da yakın tarihte bu haklar hasta haklarının gerisinde kalmıştır. İnsanlığın yakın geçmişte yaşadığı pandemiler ve günümüzdeki COVID-19 pandemisi hekimlerin insanlık için ne kadar mühim bir rol ve zorlu bir görev üstlendiğini göstermiştir. Pandemiler hekimlerin işlevsel haklar ile korunması gerektiğini kanıtlamıştır. Çalışmamız kapsamında işte bu hakların tespit edilmesi ve açıklanması hedeflenmektedir. Bu hedef doğrultusunda çalışmamızın ilk bölümünde pandeminin ne olduğu ile geçmişteki pandemiler ve mevcut pandemi incelenmiştir. İkinci bölümdeyse hekim haklarının gelişimi, insan hakları ve tıbbı deontoloji içindeki konumu, hekim haklarının neler olduğu ve pandemi koşullarındaki durumları açıklanmıştır. Çalışmamız kapsamında ulusal ve uluslararası kaynaklar ve mevzuat incelenmiş olup mahkeme içtihatlarıyla birlikte hekim hakları derlenmiş ve korunması ile geliştirilmesi için öneriler verilmiştir. This study is carried out with the aim of determining and explaining physician rights, which are in the background compared to patient rights in today's legal literature, and examining them within the pandemic conditions, where the greatest dangers for physicians are experienced. Medicine is a profession of great importance for humanity. Physicians even risk their lives for individual and public health. Physicians who take on very important duties in the society have had various rights throughout history but these rights have lagged behind patients' rights in recent history. The pandemics that humanity has experienced in the recent past and the current COVID-19 pandemic have shown what an important role and challenging task physicians play for all humanity. Pandemics have proven that physicians must be protected by functional rights. Within the scope of our study it is aimed to determine and explain these rights. In line with this goal in the first part of our study the concept of the pandemic, past and current pandemics were examined. In the second part the development of physician rights, their position within the human rights and medical deontology, contents of physician rights and their situation under pandemic conditions are explained. Within the scope of our study, national and international sources and legislation were examined, physicians' rights were compiled together with jurisprudence and suggestions were given for their protection and improvement.
