Bilgisayar programlarının fikri mülkiyet hukuku çerçevesinde korunması

Abstract

Bilgisayar programlarına hukuki koruma sağlanması meselesi, bu endüstrinin büyük hızla gelişmesi ile beraber son yıllarda önem kazanmış ve bu husus uluslararası platformlarda tartışılmaya başlanmıştır. Bu tartışmalarda hukuki koruma patent, haksız rekabet, ticari sır ve telif hakkı boyutlarıyla ele alınmış ve bilgisayar programları için en elverişli hukuki koruma biçiminin telif hakkı koruması olduğu üzerinde consensus sağlanmıştır. Bu doğrultuda çalışmamızda bilgisayar programlarının telif hukuku kapsamında, bir başka deyişle Fikir ve Sanat Eserleri Kanunu kapsamında korunması ele alınmıştır. Çalışmamızda öncelikle bilgisayar programlarının tanımına ve bilgisayar programlarına ilişkin uluslararası telif hakkı antlaşmalarına yer verilmiş, daha sonrasında bilgisayar programlarının telif hakkı koruması kapsamında yer alan ve almayan unsurları açıklanmıştır. Çalışmanın devamında Amerikan ve AB Hukuku'na göre bilgisayar programlarının telif hukukunca korunması konusunun açıklanmasının ardından konuya ilişkin Türk Hukuku'nda yer alan hükümler ayrıntlı bir şekilde incelenmiştir. Bilgisayar programlarının hukuki işlemlere konu olması hususu ayrı bir çalışma teşkil edebilecek denli geniş olduğundan, bu çalışma kapsamı dışında bırakılmıştır.

The issue of providing legal protection for the computer programs and software have become important in the last decades upon rapid development of this industry and was discussed in the international platforms. In this discussions, the legal protection was examined with respect to patent, unfair competition, trade secret and copyright aspects and a consensus was established that the copyright protection is the most adequate form of protection for computer programs. Within this direction, copyright law protection for computer programs, in other words, the legal protection provided by the Law on Intellectual and Artistic Works is examined in a comperative aspect with the U.S. and EU Law. In our study, first the definition of the computer programs and the international copyright agreements concerning the computer programs are given, afterwards, the elements of the computer programs both included and excluded from the scope of the copyright protection are explained. Then, the protection of the computer programs by copyright law according to the U.S. and EU Law are explained in the study and the provisions of Turkish Law concerning this subject are examined in detail. Since the fact that computer programs subjected to legal transactions is so extensive that it may constitute a seperate study, therefore it is excluded from the scope of this study.
