Airbnb platformu aracılığıyla akdedilen konut kullanımına ilişkin sözleşmelerin 7464 sayılı kanun ve ilgili yönetmelik çerçevesinde değerlendirilmesi

Abstract

Dünya genelinde teknolojinin gelişimiyle birlikte insanların alışkanlıkları da değişmektedir. Özellikle internetin yaygın kullanımıyla birçok alanda dijitalleşme yaşanmaktadır. Dijitalleşmenin getirdiği kolaylıklardan yararlanmak isteyenlerin sayısının ve bu kişilerin oluşturduğu talebin artması, pek çok sektörde teknoloji odaklı girişimlerin gelişerek hızla büyümesine imkân tanımıştır. Bu sektörlerin başında turizm gelmektedir. Bilindiği üzere turizm, birçok ülke için önemli bir gelir kaynağıdır. Ülkeler, geçmiş yıllarda turizm endüstrisini oteller gibi turizm tesisleri üzerinden düzenlemiş ve bu tesisleri sıkı şekilde denetlemiştir. Ancak teknolojinin etkisiyle hızla yükselişe geçen kısa süreli konut kiralama platformları, turizm sektörü açısından son derece önemli hale gelmiştir. Bu platformların öncüsü ise Airbnb'dir. Airbnb platformu, kuruluşundan bugüne kadar kısa bir süre içinde hızla gelişmiş ve bugün global ölçekte en büyük şirketlerden biri olmuştur. Airbnb ve benzeri platformların turizm sektöründeki yoğun kullanımıyla birlikte çeşitli sorunlar ortaya çıkmış ve buna bağlı olarak ülkeler, düzenlemeler yaparak bu sorunlara çözüm arama yoluna gitmiştir. Bu alandaki ilk adım, Amerika Birleşik Devletleri'nde New York Eyalet İdaresi tarafından atılmıştır. Avrupa, bu adımları takip ederek kısa süreli kira ilişkilerini regülasyonlarla düzenlemeye başlamıştır. Türkiye ise 7464 sayılı "Konutların Turizm Amaçlı Kiralanmasına ve Bazı Kanunlarda Değişiklik Yapılmasına Dair Kanun" ile kısa süreli kiralamalarda önemli düzenlemelere yer vermiştir. Çalışmanın birinci bölümünde Airbnb platformunun yapısı değerlendirilmiş ve taraflar arasındaki hukuki ilişki tespit edilmeye çalışılmıştır. Çalışmanın ikinci bölümünde ise turizm amaçlı kiralama sözleşmesinin yeni düzenlemeler çerçevesinde yapısı ele alınarak Airbnb platformu aracılığıyla akdedilen yüz gün ve yüz günden kısa süreli konut kirası sözleşmeleri bakımından yeni düzenlemelerin hukuki sonuçları üzerinde durulmuştur.

With the advancement of technology worldwide, people's habits are also changing. Particularly with the widespread use of the internet, digitalization is occurring in many areas. The increasing number of people seeking to benefit from the conveniences brought by digitalization and the growing demand from these individuals have allowed technology-focused enterprises in many sectors to develop and expand rapidly. Among these sectors, tourism stands out. As is well known, tourism is an important source of income for many countries. In the past, countries regulated the tourism industry through tourism facilities such as hotels and strictly supervised these facilities. However, short-term rental platforms, which have rapidly risen with the impact of technology, have become extremely important for the tourism sector. The pioneer of these platforms is Airbnb. Since its establishment, Airbnb has rapidly developed in a short time and today has become one of the largest companies on a global scale. With the intensive use of Airbnb and similar platforms in the tourism sector, various problems have emerged, and consequently, countries have sought solutions to these problems through regulations. The first step in this area was taken by the New York State Administration in the United States. Following these steps, Europe has started to regulate short-term rental relationships with regulations. Turkey, on the other hand, has included significant regulations in short-term rentals with the Law No. 7464 on "Tourism-Oriented Rental of Housing and Amendment of Certain Laws". In the first section of the study, the structure of the Airbnb platform has been evaluated, and the legal relationship between the parties has been identified. In the second section of the study, the structure of tourism-oriented rental agreements within the framework of new regulations has been addressed, and the legal consequences of the new regulations concerning housing rental agreements of one hundred days and shorter concluded through the Airbnb platform have been emphasized.
