COMMITTING THE CRIME OF FRAUD WITH THE INTENTION OF OBTAINING THE INSURANCE AMOUNT

Abstract

Obtaining benefits from the insurance company under the name of insurance price by fraudulent behaviour on the insurance subject constitutes the qualified form of the crime of fraud stipulated in the Turkish Criminal Code No. 5237. This crime is completed by obtaining benefit in favour of the perpetrator or a third party at the expense of the insurance company. Insurance fraud is a loss crime for which a result is sought in the legal definition. The commission of this offence by three or more persons together or within the framework of the activities of an organisation is foreseen as a reason for increasing the penalty. For this offence, effective remorse provisions are included as a personal reason for a reduction in the penalty. In our study, the commission of the offence of fraud with the intention of obtaining insurance proceeds is discussed within the framework of the systematic framework specific to criminal law. It is controversial whether the legal issue of this offence is property and/or freedom of will, whether legal entities can be the victim of this offence, whether the offence is committed if the benefit to be obtained by the perpetrator or the third party is justified, whether the element of deception is objectively suitable for deception, and when the enforcement actions begin. The controversial issues are discussed in the light of the doctrine and the current case law of the Court of Cassation and solutions are presented.

Sigorta konusu üzerinde hileli davranışlarda bulunmak suretiyle sigorta şirketinden sigorta bedeli adı altında menfaat temin edilmesi, 5237 sayılı Türk Ceza Kanunu’nda öngörülen dolandırıcılık suçunun nitelikli halini oluşturmaktadır. Bu suç sigorta bedelinin sigorta şirketi zararına failin ya da üçüncü kişinin lehine yarar elde edilmesiyle tamamlanır. Sigorta dolandırıcılığı, kanuni tanımda bir neticenin arandığı zarar suçudur. Bu suçun üç veya daha fazla kişi tarafından birlikte işlenmesi ya da bir örgütün faaliyeti çerçevesinde işlenmesi cezanın arttırılmasını gerektiren bir neden olarak öngörülmüştür. Bu suç için cezada indirim yapılmasını gerektiren şahsi bir sebep olarak etkin pişmanlık hükümlerine yer verilmiştir. Çalışmamızda, dolandırıcılık suçunun sigorta bedelini almak maksadıyla işlenmesi ceza hukukuna özgü sistematik çerçevesinde ele alınmıştır. Bu suçun hukuki konusunun malvarlığı ve/ya irade özgürlüğü olması, tüzel kişilerin bu suçun mağduru olabilme durumu, failin ya da üçüncü kişinin elde edeceği menfaatin haklı olması halinde suçun işlendiğinin kabulü, hile unsurunun objektif olarak kandırmaya elverişli olup olmadığı, icra hareketlerinin ne zaman başlayacağı hususları tartışmalıdır. Tartışmalı olan hususlar, öğreti ve güncel Yargıtay içtihatları ışığında ele alınmış ve bu konuda çözüm önerileri sunulmuştur.
