Tıp hukuku bağlamında insanı geliştiren biyoteknoloji uygulamaları

Abstract

Gelişen biyoteknoloji ile birlikte tıbbi birtakım uygulamaların, tedavinin ötesine geçerek insan vücudunun doğal yapı veya işleyişini değiştirerek müdahalede bulunmak suretiyle gerçekleştirilmesi insan geliştirme olarak adlandırılmaktadır. Bu durum birey ve toplum nezdinde hukuki birçok sorunu beraberinde getirmektedir. Felsefi değerlendirmelerle insan ve insan onuru kavramları yeniden sorgulanmakta ve tanımlanmakta, transhümanizm kavramı ile tanışılmış olmanın yanı sıra konu ile alakalı tıp etiği ekseninde temel tartışmalar yapılmaktadır. Gerek karşılaştırmalı hukukta gerekse güncel mevzuat kapsamında insan geliştirme konusu henüz etraflıca ele alınmış değildir. Geçmişte tedavi kapsamı içerisinde yer alan fakat bugün ve yakın gelecekte tedavi sınırını aşan; sibernetik organizmalar ve gelişmiş protezler, yaşlanma engelleyici uygulamalar, nörolojik ve genetik müdahalelerin seyri toplumsal bir mesele haline gelmektedir. Bu müdahaleler tıbbi gereklilik şeklindeki hukukilik şartı konusunda önemli problemler doğurmaktadır. Bu tez çalışmasında insan geliştirme mahiyetinde biyoteknoloji uygulamalarının bugünü, geçmişi ve geleceğine yönelik uygulamalar tıp hukuku bağlamında ele alınmıştır. Toplumsal sonuçlarına yönelik temel meseleler belirlenmiş, örneklerden yola çıkarak birtakım çözümler önerilmiştir: Endikasyon koşulunun kapsamı genişletilerek tıbbi gereklilik kavramı yeniden ele alınabilecek, uygulamalar için etik kurul onayı gibi şartlar öngörülebilecek, adalet ilkesi gereğince toplumsal eşitsizliğe yol açacak birtakım uygulamalar kısıtlanabilecektir.

Along with the emerging biotechnology, medical practices are performed beyond the treatment by changing the natural structure and functioning of the human body which is called as human enhancement. By this means it brings many legal problems with regard to the individual and the society. The concepts of human and human dignity are re-questioned and re-defined with philosophical considerations, as well as the concept of transhumanism is introduced to the discussion. The main debates are performed in the scope of medical ethics related to the subject. The human enhancement issue has not yet been addressed in the context of both comparative law and current Turkish legislation. In the past, it was considered in the scope of treatment. However, today and near future it is applied beyond the purpose of treatment by applications as follows; cybernetic organisms and advanced prostheses, anti-aging treatments, the course of neurological and genetic interventions. These interventions have become a social issue and create significant problems in terms of the legal requirement for medical necessity. In this thesis; past, present and future of human enhancement technologies have been discussed in the context of medical law. The main issues related to the social consequences have been identified. Following solutions are proposed based on the applications: The scope of the medical indication should be expanded regards to the medical necessity and also ethics committee approval may be required. Besides, in accordance with the principle of justice, applications resulted with social inequality should be restricted.
