COMPENSATION FOR DAMAGES IN POLLUTION OF MARINE ENVIRONMENT BY OIL AND OTHER HARMFUL SUBSTANCES ACCORDING TO LAW NO. 5312

Abstract

Oil transportation is carried out by sea on a large scale. This is a significant threat to the pollution of the marine environment. Coastal facilities and oil platforms located at sea are other factors that should be taken into consideration in the possible marine pollution.In terms of our country, which has a natural passageway consisting of the Bosphorus, the Marmara Sea and the Dardanelles, oil transportation includes a significant danger with respect to marine pollution.Referring to the importance of the issue Turkey is a party to almost all of the Conventions relating to the protection of the marine environment. Many of the provisions of the Convention was implemented on Turkey. Significant arrangements have also been made in domestic legislation which has not been enough. One of the main regulations is Law No. 5312 on "The Act on Principles of Intervention in Urgent Cases of Pollution of the Sea Environment by Oil and Other Noxious Items and Compensation (UCPS Act)”. In this study, the parties responsible for pollution damage, the scope of pollution damages, the determination of the damage, the guarantee and compensation principles are examined within the scope of the provisions of the UCPS Act. The duties and responsibilities of the authorized institutions and institutions to be prepared for emergencies are beyond the scope of the study.

Petrol taşımacılığı, büyük ölçekte denizyoluyla yapılmaktadır. Bu ise deniz çevresinin kirlenmesi açısından önemli bir tehdittir. Denizde konuşlu petrol platformları da muhtemel deniz kirliliğinde önemle dikkate alınması gereken bir diğer faktördür. İstanbul Boğazı, Marmara Denizi ve Çanakkale Boğazı’ndan oluşan doğal bir geçiş yoluna sahip ülkemiz açısından petrol taşımacılığı, deniz kirliliği bakımından önemli bir tehlike de içermektedir. Konunun önemine istinaden Türkiye deniz çevresinin korunması ile ilgili konvansiyonların hemen hemen tamamına taraftır. Birçok konvansiyon hükümleri Türkiye hakkında uygulamaya girmiştir. Bununla yetinilmemiş iç mevzuatta da önemli kanuni düzenlemeler yapılmıştır. Başlıca düzenlemelerden biri de, 5312 sayılı “Deniz Çevresinin Petrol ve Diğer Zararlı Maddelerle Kirlenmesinde Acil Durumlarda Müdahale ve Zararların Tazmini Esaslarına Dair Kanun’dur. Bu çalışmada, 5312 sayılı kanun hükümleri çerçevesinde kirlenme zararlarının sorumlu tarafları, kirlenme zararlarının kapsamı, zararların belirlenmesi, güvence altına alınması ve tazminine dair esaslar incelenmektedir. Acil durumlara hazırlıklı olmaya dair yetkili kurum ve kuruluşların görev ve sorumlulukları çalışma kapsamı haricindedir.
