dc.description.abstractHiç kuşku yok ki, insan hakları doktrini, Aydınlanma süreci ve liberal içeriklianayasal devrimlerle birlikte Batı’da şekillenmiş nispeten ‘modern’ bir olgudur. Buanlamda Osmanlı İmparatorluğu’nun insan haklarına ilişkin performansını ele almakbir bakıma anakronik görünebilir. Ne var ki, kavramın kendisine odaklanmak yerine,medenî ve siyasî haklar ile iktisadî, sosyal ve kültürel hakların tekabül ettiği haklarave güvencelere odaklanıldığı takdirde, bu tür bir tahlil çok da anlamsız olmayacaktır.Bu çerçevede, bu makale çalışmamızda, yaşama hakkı, işkence yasağı, din özgürlüğü,yargı bağımsızlığı, maddî anlamda insanca yaşam, ve azınlık hakları gibi konularbaşta olmak üzere, Osmanlılar devrinde, devletin, özellikle İslam Hukuku’nunaçıkça düzenlediği alanlarda, tebaaya güçlü hukukî ve yargısal güvenceler sağladığıve genel olarak keyfî davranmaktan uzak olduğu ifade edilmektedir. Hatta Osmanlıdevletinin, çağdaşı olan Avrupa devletlerine kıyasla, insan hakları alanında oldukça iyibir performans sergilediğini belirtmek gerekir. O nedenle, insan hakları doktrinininkapsamına giren haklar kümesi bağlamında Osmanlıların tasavvur ve uygulamalarınaodaklanılmasının, uluslararası düzeyde insan hakları literatürüne önemli bir katkısunacağı açıktır.
dc.description.abstractNo doubt, human rights doctrine is a relatively modern phenomenon which has beenshaped in the West through the Enlightenment and the constitutional revolutions ofa liberal nature. It may therefore be seen as somewhat anachronistic to focus onthe human rights performance of the Ottoman Empire. However, if one focuseson the rights and assurances that emanate from civil and political rights as well asfrom economic, social and cultural rights instead of on the concept itself, such ananalysis would not be out of place. In this context, this article asserts that, particularlyin areas regulated by the Islamic Sharia Law such as right to life, prohibition oftorture, freedom of religion, independence of the judiciary, sustenance of the basicneeds of the individual, and the rights of minorities, the Ottoman administrationprovided strong legal and judicial protection for the subjects and generally avoidedtreating them arbitrarily. It could even be argued that the Ottomans displayed betterperformance in the field of human rights when compared to its contemporaries inEurope. Therefore, highlighting the Ottoman perceptions and practices in regard tothe list of rights falling into the ambit of the human rights doctrine, should make animportant contribution to the international literature on human rights.
