FAKHR al-D?N al-R?Z? SCHOOL in the USUL al-FİQH

Abstract

In this article, I refer to Fakhr al-D?n al-R?z? and his followers as "Fakhr al-D?n al-R?z? School in the Usul al-Fiqh", and present the main features of the R?z? school, taking into consideration the usul works of R?z? and seven usul scholars among his followers. R?z? broke new ground in the writing of usul al-fiqh by reconstructing it within the framework of his own approaches on knowledge and method. With the efforts of R?z?, his followers and the ?mid? – Ibn al-H?jib line, usul al-fiqh was transformed in various aspects such as its subject, purpose, principles, issues, subject arrangement, language and style, and this transformation has had an impact beyond the borders of madhhabs. Therefore, it can be said that the late classical period (period of mutaakhkhir?n) in usul al-fiqh began with the works of these scholars. For the same reason, understanding the contributions of the R?z? School forms the basis of an in-depth understanding of the developments in usul al-fiqh in the late classical period. Although Ghaz?l? had a very important role in this transformation process, it is the works of R?z? and ?mid? that fully reflect the transformation in the scientific mentality. al-Mahs?l and al-Ihk?m, which these two scholars wrote respectively, based on the principles of logic and the "tahq?q (investigation)" method, determined the usul writing in the period of mutaakhkhir?n.

Bu makalede Fahreddin er-Râzî ve onun takipçilerini “Fıkıh Usulünde Fahreddin er-Râzî Mektebi” şeklinde terimleştirmekte, Râzî’nin ve onun takipçileri arasından yedi usulcünün usul eserlerini dikkate alarak, Râzî mektebinin belli başlı özelliklerine değinmekteyiz. Râzî, kendi bilgi ve yöntem anlayışı çerçevesinde fıkıh usulünü yeniden inşa etmesiyle usul yazımında yeni bir çığır açmıştır. Râzî’nin, onun takipçilerinin ve Âmidî – İbnu’l-Hâcib çizgisinin çabalarıyla fıkıh usulü; konusu, gayesi, ilkeleri, meseleleri, konu tertibi, dil ve üslubu gibi çeşitli açılardan dönüşüm geçirmiştir ve bu dönüşümün mezhep sınırlarını aşan bir etkisi olmuştur. Dolayısıyla bu âlimlerin eserleriyle birlikte fıkıh usulünde müteahhirûn döneminin başladığı söylenebilir. Aynı sebeple Râzî Mektebi’nin katkılarının anlaşılması, müteahhirûn dönemi fıkıh usulünün gelişimine dair derinlikli bir kavrayışın temelini oluşturur. Bu dönüşüm sürecinde Gazâlî’nin çok önemli bir rolü olmakla birlikte ilim zihniyetindeki dönüşümü tam olarak yansıtanlar Râzî’nin ve Âmidî’nin eserleridir. Onların mantık kaidelerine ve “tahkik” yöntemine dayalı olarak yazdıkları el-Mahsul ve el-İhkâm, müteahhirûn döneminde usul yazımını belirlemiştir
