Dental implant tedavisinde diş hekiminin hukuki sorumluluğu

Abstract

Tıp etiği ve tıbbi deontolojinin yanı sıra hukuksal açıdan da sorumlulukları olan diş hekiminin tıbbi müdahalelerini doğrudan veya dolaylı olarak düzenleyen birçok kanun, tüzük, yönetmelik, yönerge ve tebliğ, kararlar açısından sağlık mevzuatımızda yer almakla birlikte; mesleki uygulamalar sırasında, alınan kararların ve yapılan müdahalelerin hiçbirinde, diş hekiminin sorumluluğunu doğuran hukuki sorumluluk içeren özel bir hüküm bulunmamaktadır. Bununla beraber, hekimlik pratiğine ilişkin kabul edilen ilkeler diş hekimleri için de geçerli olup, mesleki sorumluluklara aykırı davranışlar da genel yasal düzenlemeler çerçevesinde giderilmektedir. Dental implant cerrahisi alanında tıbbi müdahalenin hukuka uygun olması için tıbbi müdahalenin, tıp mesleğini icra etmeye yetkili kişi tarafından yapılması, endikasyonu olması, hastanın bilgilendirilmiş olurunun alınması ve tıbbi müdahalenin tıbbi standartlara uygun olarak yapılması gereklidir. Hekim ile hasta arasındaki sözleşmenin niteliği konusunda öğretim ve uygulamada farklı görüşler bulunmaktadır. Sözleşmenin niteliği tıbbi müdahalenin içeriğine ve baskın amacına göre belirlenmektedir. Hekim ve hastanın vekâlet sözleşmesinden doğan bir takım genel borçları olmakla birlikte, sözleşmenin eser sözleşmesi olarak tanımlandığı durumlarda sadece bu sözleşmeye özel borçlar da söz konusu olabilmektedir. Ancak şartlar yerine getirildiği takdirde hekim, hukuki sorumluluk neticesinde hastanın maddi ve manevi zararını tazmin etmek zorundadır.

There is no special provision that includes legal liability. The accepted principles regarding the practice of medicine are also valid for dentists, and behaviors contrary to professional responsibilities are eliminated within the framework of general legal regulations. In order for the medical intervention in the field of dental implant surgery to be legal, the medical intervention must be performed by the person authorized to practice the medical profession, it must have an indication, the patient's informed consent has been obtained, and the medical intervention must be performed in accordance with medical standards. There are different views in teaching and practice about the nature of the contract between the physician and the patient. The nature of the contract is determined by the content and dominant purpose of the medical intervention. While the physician and the patient have some general debts arising from the agreement of attorney, in cases where the contract is defined as a production agreement, they also have debts specific to this contract. If the conditions are met, the physician has to compensate the patient for material and moral damage as a result of legal responsibility.
