Osmanlı Devleti ile Yahudi Cemaati Arasındaki Hukuki İlişkiler Hakkında Kısa Bir Değerlendirme

Abstract

Osmanlı Devleti?nde toplum, hukuki, siyasi ve sosyal açılardan çeşitli kategorilere ayrılmıştır. Bu kategorilerden biri, bireylerin dini inançlarına dayalı olarak yapılan sınıflandırmadır; bu bağlamda Müslümanlar ile Gayrimüslimler (zimmîler) arasında yapılan ayrım, millet sistemi çerçevesinde kurumsallaştırılmıştır. Osmanlı'da yüzyıllar boyunca uygulanan millet sistemi, özellikle dini-idari temele dayalı bir organizasyon biçimi olarak dikkat çeker. Müslümanlar ile Gayrimüslimler arasındaki gruplandırmada Yahudiler de dâhil olmak üzere, tüm Gayrimüslimler, bireysel düzeyde Osmanlı Devleti'nin tebaası kabul edilirler. Ancak, Osmanlı'nın kendine özgü yönetim yapısı gereği, Gayrimüslimler sadece devletin tebaası olmakla kalmamış, aynı zamanda bağlı oldukları cemaatin, yani milletlerinin de doğal bir üyesi olarak kabul edilmişlerdir. Millet sistemi, özellikle İslam hukukundaki zimmet sözleşmesiyle ilişkilidir ve bu, devletin Gayrimüslimlerle olan ilişkisini belirleyen temel faktörlerden biri sayılır. Bu bağlamda, Yahudi milletinin Osmanlı'daki statüsü de zimmet akdi ile yakından bağlantılıdır ve Yahudilerin toplum içindeki yeri ve yönetimle olan ilişkilerini şekillendiren önemli bir unsurdur. Bu çalışmada, Osmanlı Devleti'nin Gayrimüslim tebaasını oluşturan üç ana milletten biri olan Yahudilerin, Osmanlı hukuk sistemi içindeki genel konumu ve özellikle de yönetim karşısındaki statüleri ele alınacak ve incelenecektir.

In the Ottoman Empire, society was divided into various categories from legal, political, and social perspectives. One of these categories was the classification of individuals based on their religious affiliation; in this context, the distinction between Muslims and non-Muslims was institutionalized within the framework of the millet system. The millet system, which was applied in the Ottoman Empire for centuries, stands out as a form of organization founded primarily on religious and administrative principles. In the grouping of Muslims and non-Muslims -including Jews- all non-Muslims were recognized at the individual level as subjects of the Ottoman state. However, due to the Empire?s distinctive administrative structure, non-Muslims were not only considered subjects of the state but also regarded as integral members of their respective confessional communities, that is, their millets. The millet system was closely connected to the dhimma contract in Islamic law, which constituted one of the fundamental factors shaping statecommunal relations with non-Muslim populations. In this regard, the status of the Jewish millet in the Ottoman Empire was closely tied to the principles of dhimma and served as a significant element in defining both the community?s position within society and its state-communal relations with the Ottoman administration. This study will examine the general position of the Jewish millet -one of the three principal non-Muslim millets of the Empire -within the Ottoman Shari?a-based Legal Framework, with particular attention to their status in the context of the Ottoman administration.
