Examples of Temporary Protection in Comparative Law: The United States, Germany, and Lebanon

Abstract

Global migration is a current and problematic subject. This issue has become more difficult as a result of huge influxes, which is one of the challenges the globe is facing. Serious human rights breaches are sometimes reported as a result of different countries' migration policies and related domestic legislation. Due to the long-term need for sustainable and rights-based migration policies, our research will look at examples of temporary protection regimes in the United States, Germany, and Lebanon. The study's scope is limited to temporary protection in the United jurisdictions of America, Germany, and Lebanon due to a lack of examples of its implementation and the various migration policies established by the relevant jurisdictions. These examples will be used to evaluate temporary protection measures.

Küresel seviyede göç güncel ve problematik bir konudur. Özellikle son dönemlerde dünyanın baş etmeye çalıştığı durumlardan biri olan kitlesel akınlarla bu konu daha da sorunlu bir hal almıştır. Ülkelerin farklı göç politikaları ve buna bağlı iç mevzuatları sebebiyle bazen ciddi insan hakları ihlali yaşanmaktadır. Daha uzun vadede sürdürülebilir ve hak temelli göç politikalarına ihtiyaç duyulması sebebiyle çalışmamızda Amerika Birleşik Devletleri, Almanya ve Lübnan ülkelerinde bulunan geçici koruma rejimi örnekleri incelenecektir. Çalışmanın kapsamının Amerika Birleşik Devletleri, Almanya ve Lübnan ülkelerinde uygulanan geçici koruma olmasının sebebi geçici korumanın uygulama örneklerinin sınırlı olması ve ilgili devletlerin uyguladığı farklı göç politikalarıdır. Bu örnekler üzerinden geçici korumaya ilişkin değerlendirmeler yapılacaktır.
