In the contemporary global economic landscape, characterized by intensified international economic relations, the determination of applicable legal rules to address cross-border competition infringements gives rise to substantial theoretical and practical debates. In this context, the "effects doctrine" emerges as a pivotal principle, particularly in terms of jurisdiction and applicable law in competition law. The present article undertakes an examination of the function of the effects doctrine from the perspective of private international law, and proceeds to analyze its place within the framework of Turkish law. This analysis is informed by two fundamental legal instruments: Article 2 of the Law No. 4054 on the Protection of Competition and Article 38 of the Law No. 5718 on Private International Law and Procedural Law. Furthermore, a comparative analysis of the development and application of the effects doctrine within the legal systems of the Anglo-American and European Union is conducted, with particular attention paid to the practical application of the criteria of "direct, substantial, and reasonably foreseeable effect." A thorough examination of select landmark decisions issued by the Turkish Competition Authority pertaining to cross-border conduct illuminates the tangible impact of foreign enterprises on the Turkish market.
