Türkiye'de hukuk devletinin gelişimi ve 1982 Anayasası

Abstract

Teorik anlamda temelleri Antik Yunan düşünürlerine kadar götürülebilecek olan "hukuk devleti" kavramı, tarih içinde gerçekliğini; 1215 yılında Magna Carta ile başlayıp 1789'da İnsan ve Yurttaş Hakları Bildirisi ile devam eden ve 1948 yılında İnsan Hakları Evrensel Beyannamesi ile sonuçlanan bir süreç içerisinde var etmiş sayılmaktadır. Bu anlamda, "hukuk devleti" kavramı temelde kendisini oluşturan iki kavram olarak "hukuk", "devlet" ve bunlara ek olarak "adalet" mefhumu çerçevesinde işlenmektedir. Bu temel üzerine; temel hak ve özgürlüklerin güvence altına alınması ve bunların ancak kanunla sınırlandırılabilmesi, devlet iktidarının sınırlandırılması ve kuvvetler ayrılığı, yasama ve yürütmenin işlemelerinin yargısal denetimi, yargı bağımsızlığı, kanuni idare, evrensel hukuk ilkelerinin geçerliliği, kanun önünde eşitlik, devlet faaliyetlerinin belirliliği ve idarenin mali sorumluluğu ilkeleri ile hukuk devleti bir bütün olarak inşa edilmektedir. Bu bağlamda, biz de bu çalışmamızda, "Sened-i İttifak" ile başlayıp 2017 Anayasa değişikliğine kadar uzanan süreçte ülkemizde yaşanan Anayasal gelişmeleri hukuk devleti kavramı çerçevesinde; hem hukuk, devlet ve adalet hem de söz konusu hukukun evrensel ilkeleri kapsamında inceleyecek ve böylece "mümkün olan en iyi anayasa" üzerinde yürütülen düşünsel çabalara birtakım katkılar sağlamaya çalışacağız.

Although its theoretical basis could be found in the ideas of the Ancient Greek thinkers, the realization of the "state of law" in the history is seen within the process which started in 1215 with Magna Carta Libertatum, continued in 1789 with the Declaration of the Rights of Man and of the Citizen and reached its peak in 1948 with the Universal Declaration of Human Rights. In this perspective, the conception of the "state of law" is treated in the framework of "law", "state" and additionally "justice". On this base, the state of law is built as a whole on the principles of the restricting fundamental rights and freedoms by law, the limitation of state power and seperation of powers, the judicial review on legislative and executive bodies, the independence of judiciary, the constituional state, the rule of law, the equal protection of law, the clarity and definiteness of executive action, the liability of administration in tort. In this context, in our work, we will examine the constitutional developments of our country from "Sened'i İttifak" to the constitutional amendments in 2017, within the framework of the concept of state of law; in the scope of law, state and justice and of the universal law principles, thus we hopefully can provide some contributions to the intellectual endevaour on the "best possible constitution".
