dc.description.abstractBirden fazla kişinin taksirli hareketlerinin neticeye katkı sağladığı taksirli suçlarda, ilk taksirli hareketi gerçekleştiren kişinin sorumluluğunun belirlenmesinde neticenin objektif öngörülebilirliği şeklindeki unsur ön plana çıkmaktadır. İlk taksirli harekete üçüncü bir kişinin taksirli hareketinin eklendiği durumlarda, nedensellik bağı mevcut olmasına rağmen, objektif isnadiyet noktasında yapılacak bir değerlendirme ile ilk hareketi gerçekleştirenin ceza sorumluluğunun olmadığı söylenebilmektedir. Rücu yasağı ile de çözülmeye çalışılan bu gibi durumlarda sorumluluğun kural olarak ikinci hareketi yaparak tipik neticeyi gerçekleştiren kişiye ait olacağı ifade edilmekle beraber, ilk hareketi gerçekleştiren kişinin de sorumluluğunun olabileceği durumlara ilişkin bazı ölçütlerin geliştirildiği görülmektedir. Dahası, taksirli suçlarda neticenin objektif öngörülebilirliği sadece objektif isnadiyetin bir şartı olarak değil, hareketin taksirli hareket olarak kabulü bağlamında da gündeme gelebilmektedir. Yargıtay Ceza Genel Kurulu’nun 2015 tarihli bir içtihadı tüm bu tartışmaların somutlaştığı oldukça çarpıcı bir örnek olarak karşımıza çıkmakta ve konunun müstakil bir çalışma kapsamında analiz edilmeye değer olduğunu göstermektedir.
dc.description.abstractIn negligent offences where the negligent acts of more than one person contribute to the consequence, the element of objective foreseeability of the consequence comes to the fore in determining the responsibility of the person who committed the first negligent act. In cases where a third person’s negligent act is added to the first negligent act, although there is a causal link, the person who committed the first act may not be criminally responsible with an assessment to be made at the point of objective imputation. In such cases, which are also tried to be solved with the prohibition of recourse, although it is stated that, as a rule, the responsibility belongs to the person who actualised the criminal consequence by committing the second act, it is seen that some criteria have been developed regarding the situations in which the person who committed the first act may also be responsible. Furthermore, in negligent offences, the objective foreseeability of the consequence may be raised not only as a condition of objective imputation, but also in the context of the acceptance of the act as a negligent act. A decision of the Court of Cassation General Assembly of Criminal Chambers dated 2015 is a significant example that embodies all these discussions and proves that the issue is worth analysing within the scope of a separate study.
